SUBJECT : It is about the submission of our objections and statements against the Simple Procedure.
DESCRIPTIONS :
We submit our objections and statements within the time limit in accordance with CMK article 251 sent to my client by your court.
1. First of all, our complaint against the accused continues and we have a request to join the case. In addition, if the trial regarding this case is approved by your Court, we request that a hearing be held and a trial be held according to general provisions, not according to the simple trial procedure.
2. My client is a music teacher and currently gives baglama lessons at Seyhan Provincial Cultural Center. My client meets the defendant-debtor both because they are neighbors and because he is the defendant's baglama instructor. By taking advantage of my client's goodwill, the accused even borrowed money from my client and admitted this in his statement. However, although he was later married, the accused expressed his feelings towards my client. My client did not accept the emotional friendship and subsequently asked for the debt he owed to the defendant back and blocked him from the phone so that the defendant would not disturb him further.
3. The defendant, on the other hand, is clearly evident in the message records against my client, that he insulted my client in a way that would harm his spiritual existence. Since it is clear with concrete evidence that the accused insulted my client, we demand that the accused be punished severely without benefiting from any favorable judgment.
4. In addition, the defendant did not cover the material and moral damages of my client.
For all these reasons, it became necessary to make a statement and appeal against the simple trial procedure.
RESULT AND REQUEST: With the acceptance of our statements and objections, for the reasons presented and explained above and to be taken into consideration by your Court ex officio;
